A buddy of mine got in the middle of buying a 92 Camaro RS. The price is 2000.00. The previous owner parked it because it was running hot and he didn't have the time or the money to deal with it. My friend Mike was in serious need of some wheels for himself and he's always had a thing for the Camaro. The owner said that he lost the title in a house fire a while back but it was possible to get a mechanical lein to get full ownership of the car. Mike was familiar with mech liens so this basicly posed no problem (or so he thought!)
Well it turns out that the car doesn't have a Texas title. So Mikes connection to get a mech lien didn't want to mess with it. Mike tried to find out how he could get a copy of the Misourri title. 6 or 7 phone calls later, he then finds that the car has a bank lien against it! This pissed Mike off like you wouldn't believe! He confronted the owner about this and he confirmed that he didn't pay off the car but the bank has already wrote the loan off.
Mike finally got ahold of the bank. It turns out that the bank still has a financial interest in the car. Now Mike has to arm wrestle with the bank. The bank stated that if he can get the owner to sign over the title to him, they can work with him on getting ownership.
I cant help but think that the bank might stick Mike with some kind of outragious deal to pay for the car.

Learn from this everyone... Do not buy a vehicle unless the seller shows you a clear title!

what a nightmare.
you cant trust anybody... especially somebody desperate to get rid of a financial nightmare. right now he can part the car out and then cut his losses or he can try to find another wrecked camaro and do a little VIN swticharoo....

He might feel better if he went and punched the former owner in the grille too...

he can try to work with the bank and I doubt they would try to pull anything as the guy would be releasing his interest in the vehicle but it is not legally x-ferred into his name yet so they could not hold him liable for payments on something that is not titled to him.

He might want to consult a DMV registration service and see if they can help out. it might be worth paying them a few bucks to see if they can make some of that go away.

Mike got the paperwork to apply for a duplicate title from Mo. All he needs is "Shithead"s signature. He called the bank again to tell them as soon as he finds Shithead, he'll get the title.
The bank said,"We have the title... Send us 500.00 and we'll sign it off to you. Since Shithead defaulted on the loan, he has no legal right to the car. The bank is the sole owner and they'll get it off of their books for 500.00.
So far, Mike has paid 1100.00 to Shithead and he stopped until the title issue could be resolved. As it stands right now, Mike doesn't have to pay him anymore because Shithead wasn't the legal owner of the car.
The total cost will be 1600.00 for the car and Shithead will not get another dime. He doesn't have a leg to stand on.
Mike was thinking of taking Shithead to court over this but i am advising him to let it go. He'll be the owner of the car and it will cost financially less that what he was willing to pay. The 400 dollar difference is agravation.


Even though this has a happy outcome, Mike will never, ever buy any vehicle without a clear title in hand.

Glad it's finally settled. Shithead doesn't know where the car is does he? He might still have a key to it or just damage it in the night if he is mad.

Who's Peterbilt is that in the background? 8)

Shithead knew from the start that he was pulling some crap. He doesn't know where the car is and i doubt that he even cares at this point. He most likely wonders how lucky he was to get at least 1100 for it. His wife on the other hand might complain. She may have already spent the 900 dollars that they wont get. She might want to sue Mike for the rest but it wont hold up in court because it would most likely backfire on them. You cant sell an item if you dont legally own it. Shithead is a scrawny little old fart who would break his arm if he thru a punch. His wife on the other hand is a big ole gal. For all i know she's the county arm wrestling champion 2002, 2003, and 2004.
The Pete in the backround is Mikes work rig. He averages 4000 mi a week. I overheard one of the mechanics from his job saying that Mike keeps his truck cleaner than any other driver. Polish, polish and more polish!

Mike has been hit harder than usual with bills. His kids think dad is a atm machine. He has'nt come close to sending off for the title yet. I'm thinking he should send some of the money so that will make it legally binding that he has financial ties to the car.
I'm kinda glad that i'm going to work. This way im not close enough to get deeper into the problem.
