Ok, so im leaving the school (20mph zone), and im in 1st gear rapped out (15mph), and am on my way to 2nd, when i notice that a friend of mine hopped out in front of me just to f*** with me. I can't slam on the brakes, because it turns out i need new brake shoes, which are presently being shipped. I press the brake as much as i can without locking them up (about 1/2 way), and slam into him anywhere between 10 and 15mph, and run over his leg. This all happened at like, 3:30 this afternoon. He takes off, and im standing there like... WHAT THE F***!?? So, there's some lady on the phone calling the cops while yelling at me, "YOU SAW HIM!!!"... etc. So, i parked the truck about a half a block away, so i wasnt in the road, and walk into a business across the street from the school (kind of associated with the school, but a separate business), and waited for a half hour until the store closed, as to not get a hit-and-run, even though he left, and the cops hadn't showed up, and i left to go home. None of this was my fault (at least i think), and i do have people who saw the whole thing, but he's on his way to the emergency room right now to get his foot looked at. My insurance CAN NOT go up, or else i won't be driving anymore, and i really don't know if i should call the cops and file an accident report, or what? And to top it all off... HE F***ED UP MY PERFECT FRONT BUMPER!!!!!! :evil:

Ok, i called the police, and the officer siad "i'll deal with it later, i'm really busy right now", and that i should file a report with my insurance. The problem with that is that if i do that, im afraid that my rate will go up because of my bad brakes. Help if you can!!!! Thanks!

Wow, not a good situation. I don't think there's a win-win answer for you. Your biggest problem is going to be the lady who called the cops. My guess is that she's going to make life miserable for you while she's trying to save the day.

I think he ran off because he realized that he screwed up, which means he will probably confirm your story to everyone. That will depend upon what kind of person he is though. He may lie about it all to cover his own ass.

At any rate, hopefully someone will pipe up with the legal ramifications here, because I don't know what they are.

If you call the insurance company, you'll probably need a case number from the PD. I would get the name and badge number of the officer you spoke to, and document the time of the original phone call as well as the result of the call. I think the cop pretty much blew it when he said he was to busy, but they may not believe you if it comes down to heresay. To me, documentation is everything, but that is as far as my 2 pennies goes.

go to the lady who called the cops, be real nice, etc, and explain exactly what happened. She wasn't THERE exactly, she didn't know exactly. She called the cops based on what she thought was going on. Tell her your friend was being dumb and jumped out in front of you. If you tell her what happened and set her straight, then if the cops go to her to get what she saw, she'll know what really happened.

I don't think it's your fault but I don't know anything about insurance, police, etc. I think so long as your friend admits he purposely jumped out in front of your truck, then you have nothing to worry about (and if he doesn't, he's a horrible friend, it's all his fault) of course he didn't ask to be hit, but he shouldn't have done something so stupid as to jump out in front of a moving vehicle.

Damng, what a mess. I don't know what to say other than DON'T SAY ANYTHING ABOUT HAVING BADF BRAKES!! If anything, say " he jumped out so fast you didn't have time to fully stop before you ran his dumb ass over" I would definently try to get a hold of him ASAP, and see what his story is. GOOD LUCK, and I am really sorry to hear about the bumper :lol: :lol: :lol:

to running out in front of you, I hope you know where he lives so you can at least make his life miserable for lying about it. You should be okay as long as he fesses up, I think....and I definitely wouldn't say anything to the insurance company about bad brakes....

Well, the problem is that there was so many witnesses, and a few say that i saw him and tried to hit him, and it was obvious that if i had good brakes, i could have stopped in time. I think that the brakes are really my only defense, and im going to put new brakes on her today. I think everything's going to be ok as long as he doesnt claim his medical bills. Thanks for the support!!

I think he got what he deserved... i got out on the highway, and im doing 45mph and wobble like you wouldn't believe. The bastard locked my hubs just f***ing with me. He deserved to get hit. I almost wish i would have hit him harder :twisted:

well one thing you have going for you is that he ran away after getting hit.

I don't really see how the fact that there were witnesses could hurt you. Of course you saw him, he was right in front of you, but that doesn't mean you can stop in time

Shouldn't he get you a new bumper? I mean he's the idiot that jumped out in front of a moving vehicle, good or bad brakes besides.

Ok don't say a word about the brakes, and try to get ahold of him and the lady that called the PD, tell her what exactly was going on, and that you did not hit him on purpose. hopefully things work out for ya. Oh and when the little jerk off heals, go over to his house and wack him a couple times up side the head with your old bumper( this is of course AFTER you make him buy you a new one :twisted: ) maybe a couple more dents in it won't hurt :wink:
