So this guy backed out of his drive way right in front of me. He accused me of speeding because I 'came out of no where', my response was. 'Oh and the tree and van blocking your view had nothing to do with me 'coming out of no where'.

The terrain looks pretty flat there. You would've had to been flying to "come out of nowhere." He probably had his phone stuck to his head and was looking the other way. If he was looking at all.

that guy is going to have a hell of a time convincing anyone that it wasnt his fault, its always your fault if you back out in front of someone isnt it?

The seat belt came unlatched. I hit my head on the windshield and bent the steering wheel with my chest. Lucky the visor was down when it happened and provided a little padding. Pretty soar a little bruising, but all and all Im ok. I just happy my kid wasn't in the truck. I'm hoping this will be a slam dunk instead of a insurance battle. Any one know what the blue book of a 80 luv might be?

Not much... It's going to be hard to keep them from totaling it. You can always buy it back with a salvage title and repair it yourself.

Get a lawyer. They aren't going to pay you much for your truck. Since you got hurt, a lawyer can help get you the money you need to put it back together.

+1 on getting a lawyer, i looked into it a little bit and in the majority of states its the fault of the person backing out rather than the one already traveling down the road

Not to be an ass here but this is why I switched to Hagerty for my LUV insurance. State Farm said they cover me up to what I had receipts for, but my labor was out the door. Hagerty did a stated value with me and it is cheap per year.

Sorry to hear this. I drive into Salem every day. Peoples' advice to get an attorney is well placed. Also, it's probably not a good idea to talk about your injuries openly online. Hope this turns out ok for you.
